Welcome to PediaSpeech. These Terms and Conditions (“Terms”) govern your use of our website at https://www.pediaspeech.com/ (“Site”), as well as your relationship with us in relation to the services we provide. By accessing or using the Site or engaging our services, you agree to these Terms. If you disagree with any part of these Terms, you must not use the Site or procure our services.

“Services” means speech therapy, occupational therapy, teletherapy, feeding therapy, evaluations, and related clinical services offered by PediaSpeech.

“Content” refers to text, images, audio, video, files, data, and other materials available via the Site.
2. Use of the Site & Eligibility

Eligibility. You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Site or engage services. If you are under that age, a parent or legal guardian must oversee use and accept these Terms.

License. We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal or professional (client-related) needs, subject to your compliance with these Terms.

Prohibited Uses. You agree not to:

Use the Site in any unlawful or prohibited manner.

Post, transmit, or store material that infringes intellectual property rights or violates privacy or publicity rights.

Attempt to gain unauthorized access to our systems, interfere with Site operations, or reverse-engineer our technology.

Harass, threaten, or harm other users or staff.

3. Client Services & Obligations

Engagement. Our Services begin once a formal agreement is made (e.g. evaluation, treatment plan, consent forms) and may require required parental or legal consent for children.

Accurate Information. You must provide accurate, current, and complete information about the client (child) including health history, medical diagnosis, and other relevant data.

Cooperation & Attendance. You agree to attend scheduled sessions, arrive on time, cancel with required notice, and comply with clinician instructions. Repeated no-shows or failure to cooperate may result in termination of services.

Health & Safety. You acknowledge that therapy sessions (in-person or remote) may involve certain risks, and you agree to abide by safety instructions, report health issues, and disclose relevant conditions.
4. Payments, Insurance & Refunds

Fees. You agree to pay fees for evaluations, therapy sessions, consultation, or other services as disclosed in your service agreement.

Insurance. We may accept certain health insurance plans. However:

You are responsible for verifying with your insurer whether services are covered.

You remain responsible for co-payments, deductibles, or non-covered services.
-
If your insurance rejects or denies a claim, you are responsible for payment.

Payment Terms. Payments are due as specified (e.g. at or before each session, monthly billing). Late payments may incur interest or suspension of services.

Refunds / Cancellations.

If a session is canceled by you without notice you may be charged a cancellation or no-show fee.

In the case we cancel or reschedule, we will offer an alternate session or credit.

Fees for nonrefundable deposits or evaluation fees may not be fully refundable.

All refund decisions are at our discretion and subject to the terms in your service agreement.

5. SMS Terms & Conditions
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from PediaSpeech, LLC. This includes SMS messages for conversations (between employees), conversations (external). Message frequency varies. Message and data rates may apply. 6. Teletherapy / Remote Services (if applicable)

Technology & Access. You must use your own internet connection, hardware, audio/video equipment, and maintain a secure, private environment for sessions.

Limitations. We are not liable for technical failures, connectivity issues, or interruptions outside our control.

Confidentiality. You should ensure that sessions are not overheard or viewed by unauthorized persons.

Consent. You consent to remote services and acknowledge their limitations compared to in-person therapy.
7. Intellectual Property

Our Content. All content on the Site — text, images, logos, audio/video, designs — is owned or licensed by us and protected by copyright, trademark, and other intellectual property laws.

Limited Use. You may view, download, and print content for your personal, noncommercial use or for your child’s therapy use, provided you retain all notices of copyright or ownership.

Prohibited Reproduction. You may not reproduce, distribute, modify, publicly display, or create derivative works based on our content without express written permission.
8. Privacy & Data Protection
Your privacy is important to us. Use of the Site and our services is also governed by our Privacy Policy (https://www.pediaspeech.com/privacy-policy/). The Privacy Policy describes how we collect, use, store, and protect your personal and health information. By agreeing to these Terms, you also consent to our data practices as outlined in the Privacy Policy.
9. Disclaimers & Limitation of Liability

No Medical / Legal Advice. The content on the Site or offered via services is for informational or therapeutic purposes and does not constitute medical, legal, or other professional advice beyond the scope of therapy.

“As-Is” & No Warranty. The Site and its content are provided “as is” and “as available” without any warranties (express or implied). We do not warrant that the Site is error-free or uninterrupted.

Limitation of Liability. To the fullest extent permitted by law, PediaSpeech (and its employees, agents, affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services, even if advised of the possibility of such damages. Our maximum liability shall not exceed the fees you have paid us in the 12 months preceding the claim.

No Guarantee of Results. We cannot guarantee specific outcomes, improvements, or therapeutic success, as results vary by individual client, compliance, and other variables.
10. Indemnification
You agree to indemnify, defend, and hold harmless PediaSpeech and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

11. Termination

Your Termination. You may stop using the Site or request termination of services at any time, subject to any obligations you have under a service agreement.

Our Termination. We reserve the right to suspend or terminate your access to the Site or services for violation of these Terms, nonpayment, or other good cause, without prior notice.

Arbitration / Mediation: Any dispute not resolved may be resolved by binding arbitration (or non-binding mediation) in Dekalb County Georgia.
